Moudern PC Defeats Motion to Reclassify Civil Case

Moudern PC successfully opposed a defendant’s motion to reclassify an unlimited civil case as a limited civil case. The court denied the motion and adopted its tentative ruling, preserving the case’s unlimited civil classification. This is a procedural victory for our client.

The defendant sought to change the category under which the case would proceed. Moudern PC opposed that request, and the court declined to make the requested change. As a result, the action will continue as an unlimited civil case.

Procedural advocacy is an important part of litigation. Alongside presenting a client’s claims, counsel must address motions concerning how the case will move through the courts. These disputes deserve careful attention: a request framed as a procedural change can become a significant contested issue in the litigation.
